Reporters' Privilege Cases
Branzburg v. Hayes (1972) ruled that the First Amendment did not create a
constitutional privilege protecting reporters from having to testify in
grand jury proceedings.
In Cohen v. Cowles Media Co. (1991), the Court declined to give First
Amendment protection to a paper that was being sued for divulging a
confidential source.
In Florida Star v. B.J.F. (1989), the Supreme Court said the First
Amendment stopped a newspaper from being held liable for publishing a rape
victim’s name.
